تأثير تقرير الطبيب العدلي على قرار القاضي في جريمة الاغتصاب

يعد التقرير الطبي العدلي وسيلة من وسائل الاثبات الجنائي في جريمة الاغتصاب بل يعتبر في مقدمة تلك الوسائل التي يلجأ اليها القاضي لا حقاق الحق وانصاف الضحية والاقتصاص من الجاني في جريمة الاغتصاب وهذا التقرير مناط بجهة طبية مختصة متدربة ومتعلمة ، ان تطور المجتمعات العلمي والفني تطورت معه وسائل ارتكاب الجريمة واخفاء معالمها لذا اصبح لزاما ان يتطور الجانب الفني ووسائل اثبات الجريمة ونسبتها الى مرتكبها وهذا يتطلب حتما تطور المستوى الفني والتقني والعلمي للأطباء العدلين حتى يمكن ان يكون السبيل الى ردع المجرم ومعاقبته او منعه من ارتكاب الجريمة . ان تقرير الطبيب العدلي هو وثيقة رسمية صادرة من جهة حكومية تطلب من جهة امنية او قضائية و يكون مهما وحاسما عند غياب الوسائل الاخرى التي يمكن اللجوء اليها في اثبات ركن الجريمة المادي في جريمة المواقعة غير المشروعة دون ارادة المجني عليها .
