الملخص

نَتَجَ عن التطور العلمي والتكنولوجي في حقل الذكاء الإصطناعي إنتشار تطبيقاته المتنوعة والمعقدة على مدى واسعٍ، وقد تنطوي هذه التطبيقات في الغالب على عيوبٍ نتيجة وجود خلل تقني أو خطأ في البرمجة أو سلوك غير متوقع أو عيب في التصميم يكون من الصعب على المستهلك، سواء كان متعاقداً مع المنتج أم من الغير - من غير المختصين - العلم الكافي بدقائق تصنيعها وتفاصيل أمورها الفنية أو الإحاطة بكيفية إستخدامها وتجنب مخاطرها، بيد أنه نجد في المقابل طرفاً أقوى يُمثله المُنتِج لتلك التطبيقات الذي تتوافر لديه مقومات العلم الكافي بمعلومات المُنتَج الذي يُراد تصنيعه، وما يزيد الأمر تعقيداً تدخل أكثر من شخص في صناعة تطبيقات الذكاء الأصطناعي، وهي برمجياتٌ تقنيةٌ نشأت بواسطة متخصِّصين في علم الحاسوب، وتحمل علامات تجارية، إما خاصة بالأفراد المصَّنعين أو بالشركة التي تولت التصنيع، فيصعب تحديد هوية المسؤول عن ضرِّرها. وغالباً ما تُعرِّض تطبيقات الذكاء الإصطناعي المعيبة حياة المستهلك، ناهيك عن أمواله، إلى الخطر، وإزاء ذلك لا بدَّ من تكاثف الجهود للبحث عن السبل الكفيلة لتحقيق الحماية القانونية الناجعة للمستهلك التي تعدُّ من أولويات المشرِّع الفذة، ولعل السبيل لذلك يكون من خلال السعي إلى إقرار مسؤولية المُنتِج عن تطبيقات الذكاء الإصطناعي المعيبة وإمكانيات دفعه لها إذا ما توفرت الأسباب من جهة، وحق المتضرر في التعويض المناسب وفق آليات معينة من جهة أخرى .
