الجرائم الماسة بالاستثمار الأجنبي في المواقع النفطية (دراسة مقارنة)

الملخص

ان الاستثمار الأجنبي النفطي يمكن الدولة النامية الغنية بالموارد النفطية من الاستغلال الامثل لهذه الثروات، من خلال تطوير وتأهيل للقطاع النفطي، والتي تعول عليه في تحقيق التنمية الاقتصادية الشاملة، من خلال إعطاء قوه دافعة للاقتصاد الوطني بتحسين قدراته على التفاعل مع الاقتصاد العالمي، والمشاركة في العملية الانتاجية الدولية، غير أن البيئة الاستثمارية في قطاع نفطي قد تتعرض لتهديدات خطيرة ناجمة عن جرائم تهريب النفط، وجرائم تخريب المنشآت النفطية، فجريمة التهريب وبارتكابها  يصبح المورد النفطي خارج سيطرت الدولة مما يؤدي إلى استنزاف ثروات الدولة من جانب، والإضرار بمصالح الاستثمار من جانب اخر، اما جريمة التخريب فتأخذ طابعا أشد خطورة، اذ تستهدف البنية التحتية النفطية، اذ ان هذه الجريمة  تعطل المنشآت والمعدات الحيوية ، وتهدد سلامة العاملين والاستقرار الأمني في مناطق الاستثمار، مما تؤثر سلبا على العمليات الإنتاجية النفطية، وبالتالي تقود هذه الجرائم الى جعل القطاع النفطي بيئة طاردة للاستثمار الأجنبي النفطي، مما ينعكس سلبا على تنفيذ برامج الخطط الاستراتيجية الاقتصادية المنشودة.
