انتهاء الوساطة الالكترونية في منازعات عقود التجارة الدولية ( دراسة مقارنة)

يمثل انتهاء الوساطة الالكترونية في منازعات عقود التجارة الدولية محطة حاسمة في مسار هذه الوسيلة البديلة لتسوية النزاعات، حيث يتحدد عنده ما اذا كانت الاجراءات قد حققت غايتها في إبرام اتفاق تسوية ملزم للأطراف، ام إنها فشلت في التوصل إلى حل وفتحت المجال للجوء إلى وسائل أخرى كالتقاضي او التحكيم
وقد أظهرت الدراسة ان إنتهاء الوساطة قد يكون بالنجاح عندما يفضي إلى اتفاق مكتوب يعكس ارادة الأطراف ويكتسب حجية قانونية كما قد يكون بالإخفاق عند تعذر تقريب وجهات النظر او انسحاب احد الأطراف او حتى الوسيط نفسه كما تبين ان الطبيعة الالكترونية لهذه الوساطة تضفي عليها السمات خاصة عند الانتهاء ، سواء من حيث التوثيق الرقمي لاتفاق التسوية او من حيث التحديات المتعلقة بحماية سرية البيانات وضمان حجية المحررات الإلكترونية أمام القضاء، انتهى البحث إلى ان دراسة صور انتهاءً الوساطة الالكترونية وأثرها على عقود التجارة الدولية تمثل ضرورة لفهم الدور العملي لهذه الوسيلة في دعم بيئة تجاريّة آمنه ومرنه مع التأكد على نجاحها او فشلها ينعكس بشكل مباشر على ثقة المتعاملين في التجارة الدولية
