حدود التوسع القضائي المشروع في اختصاصات المحكمة الاتحادية العليا

يتناول هذا البحث مناقشة مفهوم التوسع القضائي وحدوده المشروعة ومتى يتحول الى تجاوز في حدود الاختصاص وانطلق من فرضية مفادها ان الاختصاصات الدستورية المقررة للمحكمة الاتحادية العليا في بعض منها تمييز بمرونة من حيث الأطراف او من حيث موضوع الاختصاص الامر الذي منح المحكمة مساحة واسعة للاجتهاد القضائي في تفسير حدود هذا الاختصاص توسعا او ضيقا و ركز البحث على تحليل المادة ٩٣ من دستور ٢٠٠٥ خصوصا الفقرات ( ثالثا ورابعا وخامسا) باعتبارها من الاختصاصات ذات المحل المرن وخلص البحث الى ان الفقرة ثالثا تقرر اختصاصا نزاعيا لا ينعقد الا بوجود خصومة نشأت عن تطبيق فعلي لتشريع او اجراء اتحادي ترتب عليه اثر قانوني مباشر بما يميزها عن الرقابة الدستورية المنصوص عليها في الفقرة أولا كما بين البحث ان الفقرتين رابعا وخامسا تنصرفان الى المنازعات بين وحدات الحكم وان عدم دقة الصياغة الدستورية وغياب تحديد واضح لمحل المنازعة في التنظيم الاجرائي اسهم في فتح مجال الاجتهاد للمحكمة الاتحادية العليا وقد ختم البحث بجملة من المقترحات في مقدمتها تشريع قانون مفصلا لاختصاصات المحكمة الاتحادية العليا منسجما مع ماورد في المادة ٩٢/الفقرة ثانيا فضلا عن الدعوة الى تعديل صياغة الفقرتين رابعا وخامسا بما يرفع الغموض ويمنع الفراغ في الاختصاص ويضمن توجه التوسع القضائي ضمن حدوده الدستورية المشروعة.
