الملخص

 

    إن الصلاحيات الواسعة التي تتمتع بها السلطة التشريعية في اقتراح القوانين ومناقشتها والتصويت عليها بما يعكس الإرادة العامة للشعب وتمثيله الحقيقي والقانوني بوجود الجهة التشريعية المنتخبة قانوناً، تطورت وطرأ عليها التغيير إذ شهدت العديد من الدول والأنظمة الدستورية تراجعاً لمبدأ الانفراد التشريعي وانحساراً لفكرته السائدة وبصورة واضحة في التشريعات المالية على وجه الخصوص، بفعل تدخل السلطة التنفيذية في العملية التشريعية ومشاركتها في أدوارها لأسباب عديدة أدت إلى تزايد الدور الذي تمارسه بمرور الوقت من خلال المساعدة في التشريع بدايةً إلى الهيمنة الواسعة على التشريع وتعاظم دورها واتساعه فيه، فصارت السلطة التنفيذية تؤثر بشكل كبير على عملية صنع القوانين المالية اتفاقاً مع الدستور الذي يعطيها هذا الحق تارةً، أو الاعتماد على التفسير الواسع لنصوص الدستور أو حتى تجاوزها تارةً أخرى، مما أدى إلى تآكل دور البرلمان كجهة تشريعية مستقلة وخصوصاً في أدوار معينة من عملية تشريع القوانين المالية.
