المركز القانوني للأجنبي اثناء النزاع المسلح – دراسة تحليليه

ان تحديد مركز الاجنبي يكون من اختصاص القانون الوطني والدولة هي صاحبة السيادة على ارضها ولها الحق ببسط سلطتها على الاجانب المتواجدين فيها , ولكن قد يتعرض الاجنبي في البلد المقيم فيه بصفة دائمة او مؤقتة الى ويلات الحروب والنزاعات المسلحة لذا لابد من وجود حماية له باعتباره مدني وطرف ضعيف يحتاج الى حماية , هذه الحماية تكفل بها القانون الدولي الانساني خلال معاهدات جنيف الاربعة عام 1949وكانت هذه الاتفاقيات عمل انساني ضد اي انتهاك لحقوق المدنيين فقد جاء في هذه الاتفاقيات قواعد لحماية ضحايا الحرب والنزاعات المسلحة فضلا عن اقرار بروتوكولين عام 1977ملحقان بالاتفاقية الاول خاص بالنزاعات المسلحة الدولية والثاني يتعلق بالنزاعات المسلحة غير الدولية .
