العنصر النفسي في تنفيذ الالتزام العقدي دراسة في القانونين العراقي والإنكليزي

تعد ارادة المتعاقدين هي الركن الاساس في تكوين العقد، اذ يفرض العنصر النفسي سلطانه على تكوين العقد ابتداء، فلا وجود لهذا الكائن القانوني بدون انصراف ارادة الاطراف لتكوينه، كما يظهر اثر العنصر النفسي في العقد بوصفه محدد للالتزامات، فإرادة اطراف العقد هي التي تحدد التزاماتهم، ومن ثم يثور التساؤل هنا عن دور العنصر النفسي في تنفيذ العقد، وتحديد نطاقه كمرحلة اولى بغية تنفيذه طبقا لما حددته ارادة المتعاقدين(طبقا لما اشتمل عليه) وبطريقة تتفق مع ما يوجبه حسن النية في مرحلة ثانية.
