تتمحور هذه الدراسة حول إشكاليات حماية حقوق الملكية الفكرية في البيئة الرقمية، بالتركيز على القصور التشريعي في القانون العراقي مقارنة بالمعايير الدولية والتجارب المقارنة. تهدف الدراسة إلى تشخيص الفجوات الموضوعية والإجرائية في التشريع الوطني، وتحديد مدى كفاية النصوص الحالية لمواجهة التحديات التقنية المستحدثة مثل النسخ الرقمي والاعتداءات العابرة للحدود. كما تسعى إلى وضع إطار قانوني مقترح لمسؤولية الوسطاء التقنيين وتفعيل التدابير التكنولوجية الوقائية. أظهر التحليل أن الخصائص الفريدة للفضاء الرقمي قد أفرزت تحديات قانونية تجاوزت آليات الحماية التقليدية. وتخلص الدراسة إلى ضرورة تبني مقاربة تشريعية متكاملة توائم بين حماية الإبداع وضمان حرية المعلومات، مع تعزيز حجية الدليل الإلكتروني في الخصومة المدنية.
