دور المحكمة الاتحادية العليا لمعالجة الانسداد السياسي في العراق

واجه النظام البرلماني الاتحادي في العراق، الذي صممه دستور 2005، تحديات بنيوية عند انتقاله من النظرية إلى التطبيق؛ فبدلاً من تشكيل حكومات أغلبية ومعارضة فاعلة، اصطدمت النصوص الدستورية ببيئة سياسية محكومة بالمحاصصة والتوافقات والتحالفات المتقلبة. هذا التعارض الحاد أنتج أزمات وانسدادات متكررة مست المحطات السياسية السيادية، بدءاً من الخلاف حول "الكتلة النيابية الأكثر عدداً" وآليات تشكيل الحكومات، وصولاً إلى حدود صلاحيات حكومات تصريف الأعمال وإجراءات حل البرلمان. وفي ظل هذا الجمود الدستوري والسياسي، برزت المحكمة الاتحادية العليا كصمام أمان ولاعب محوري في إدارة المشهد، إذ لم يقتصر دورها ــ بفضل إلزامية وباتّ أحكامها ــ على الفصل القضائي التقليدي، بل تحولت أداة التفسير الدستوري لديها إلى آلية سياسية وقانونية لفك الاختناقات، وإعادة صياغة موازين القوى، وتأمين الانتقال بين المراحل المتأزمة في البلاد.
