المواجهة الجنائية لجرائم الفساد الإداري والمالي ((دراسة تحليلية مقارنة))

تهدف هذه الدراسة إلى الإسهام في الحد والإقلال من جرائم الفساد الإداري والمالي المستشرية في المؤسسات والدوائر الحكومية العراقية بعد عام 2003، من خلال إيضاح الاجراءات الجنائية والدولية التي تؤدي إلى الحد من انتشار ظاهرة الفساد الإداري، وتحديد آثارها، وتشجيع المواطنين على استعمال حقهم في التبليغ عن هذه الجرائم الخطيرة، مع توفير الضمانات الإجرائية والقانونية الكافية للمبلغين عنها، لذا جاءت هذه الدراسة لترسي مبدا وقيمة في نفوس المواطنين بضرورة استعمال حقهم في التخلص من بؤر الفساد، بضرورة السير في الاجراءات التبليغ عن تلك الجرائم؛ لوضع حد لتزايدها، وذلك بعد بيان المسؤولية الجنائية والدولية الناشئة عن ارتكاب هذه الجرائم الخطيرة. وقد اعتمدت هذه الدراسة في الوصول إلى أهدافها من خلال الوقوف على الآليات الوطنية الرقابية والتشريعية لمكافحة الفساد في كل من التشريعين العراقي والمصري، وكذلك الآليات الدولية، مع الإشارة إلى اتفاقية الأمم المتحدة لمكافحة الفساد 2003, التي انضم إليها كل من العراق ومصر. وتكمن أسباب اختيار هذا الموضوع في التعرف على أسباب انتشار ظاهرة الفساد الإداري والمالي في المؤسسات العراقية؛ لمعرفة كيفية الحد منها، وما يمكن وضعه من آليات لمكافحتها، وما اذا كانت تلك الآليات وطنية أم دولية, ومدى تحقق المسؤولية الجنائية للأشخاص الاعتبارية والأشخاص الطبيعية الناشئة عن ارتكاب جرائم الفساد الإداري في العراق . كما كان من ضمن تلك الأسباب البحث عن أساليب إزالة المعوقات الأجرائية التي تواجه الحد من هذه الظاهرة الخطيرة، والسعي نحو توفير الضمانات القانونية والدولية لمحاسبة مرتكبي هذه الجرائم في العراق, وإبراز التشريعات التي تناولت التبليغ عن الجرائم.
