الملخص

تبحث هذه الدراسة أثر الظروف الطارئة في التوازن الاقتصادي والاجتماعي لعقد المقاولة، في إطار مقارنة منظمة بين القانون العراقي والقانونين المصري والفرنسي، مع الاستفادة من بعض الحلول الواردة في القانونين الجزائري والروسي. وتنطلق من التمييز بين الظرف الطارئ الذي يجعل التنفيذ مرهقًا، والقوة القاهرة التي تجعله مستحيلًا، وبينهما وبين المخاطر العادية التي يتحملها المقاول. واعتمد البحث المنهج التحليلي المقارن، مع دراسة نصوص المواد (146/2 و211 و878) من القانون المدني العراقي، والمادة (147/2) من القانون المدني المصري، والمادة (1195) من القانون المدني الفرنسي، والاسترشاد بالتطبيقات القضائية العراقية والمقارنة. وتوصل إلى أن حماية التوازن العقدي لا تتحقق بإعفاء أحد الطرفين من كامل الخسارة، بل بتوزيع العبء غير المألوف بصورة عادلة، مع ضرورة تمسّك المتضرر بالنظرية أثناء سريان العقد وإثبات علاقة السببية بين الحادث والإرهاق. كما خلص إلى أهمية تنظيم واجب إعادة التفاوض، وإدراج بنود واضحة لتغيّر الأسعار والتوقف والتمديد في عقود المقاولة، وتوحيد المعايير القضائية والفنية لتقدير الخسارة الفادحة والحد المعقول.
