الموازنة بين قوة السلطة والقيم الديمقراطية (دراسة دستورية تحليلية)

تمثل قوة السلطة القدرة المادية الموحدة على فرض الطاعة باستقلال تجاه الجميع وعلى اساس القانون. ولا تعني السلطة السيطرة او التسلط دائماً. وتجد قوة السلطة مصدرها الفكري في أسس عديدة منها رضا الافكار العامة للأفراد ووحدة الدولة. وتتأثر قوة السلطة بمجموعة قيم ديمقراطية أبرزها احترام عامل المعتقدات من اجل توحيد القيم التي تعد جوهراً للحق او للقانون. وان ان تكون السلطة السياسية مدنية وليست عسكرية وان تؤمن بالتداول السلمي الدوري. كما تتأثر القوة بفاعلية القانون حينما يضع شروطاً تمنع استخدام القوة بسهولة وان تتصف بالوضوح والعموم. كما تتأثر بطريقة توزيع السلطة ولا سيما في الدولة الاتحادية والتي تتطلب اشراف الاتحاد على قوات الأقاليم وبنفس الوقت تحقق المشاركة الفيدرالية. ومع ذلك اضعف دستور العراق النافذ لسنة 2005 من قوة السلطة الاتحادية بسبب عدم وجود علاقة واضحة بين حرس الاقليم والسلطة الاتحادية ولو في الظروف الطارئة. ولم يرسم طريقة محددة لتنفيذ القوانين والقرارات الاتحادية. كما بالغ المشرع في مراعاة تمثيل المكونات في القوات المسلحة. واضعف الدستور من القانون كقيد على قوة السلطة حينما سمح لها بتقييد الحقوق والحريات بناءً على قانون.
