يتيح عقد الرهن الدائن المرتهن حقا عينيا تبعيا، يكفل له ضمان استيفاء حقه من المدين حيث أن الغاية والهدف منه ضمان الوفاء بالالتزامات المترتبة في ذمة المدين وهي وسيله قانونية لحماية المعاملات واستقرار التعامل وزيادة الثقة و الائتمان، كما وان منح الكفيل العيني الحق في استيفاء ما وفى للدائن من حق ، اتجاه المدين متمتعا بالدفوع التي كان باستطاعة المدين ان يواجه بها الدائن ، فبيان المركز القانوني للكفيل في عقد الرهن التأميني يعد من الأمور المهمة لتجنب الحالات التي تكون مشابه لهذا التصرف.
