أدوات الإلتزام بالقواعد القانونية الدولية المعنية بحماية طبقة الأوزون والمناخ وموقف العراق منها

الملخص

 إن إهتمام المجتمع الدولي بقضيتي ترقق طبقة الأوزون والتغيرات المناخية وخطورتهما على العالم أجمع لما تسببه من تهديد للنظام البيئي وبالتالي خطرهما على الأمن الدولي الإنساني ، حدت به إلى تدعيم قواعد الحماية القانونية الدولية المعنية بحماية طبقة الأوزون والمناخ كإتفاقية فينا المعنية بحماية طبقة الأوزون لعام 1985 ، وبروتوكول مونتريال بشأن المواد المستنفذة لطبقة الأوزون لعام 1987 ، وإتفاقية الأمم المتحدة الإطارية المعنية بتغير المناخ لعام 1992 ، وبروتوكول كيوتو لعام 1997 ، وإتفاق باريس لعام 2015 بأدوات قانونية كالإلتزام بنظام الإمتثال الدولي لهذه الإتفاقيات ، وكذلك تطبيق مبدأ المسؤولية الدولية الناجمة عن الإخلال بقواعد الحماية تلك ، وكل ذلك يتم في إطار التنمية المستدامة الذي يدمج الأبعاد البيئية والإقتصادية والإجتماعية وعلى هذا فإن تقليل إنبعاثات الغازات الدفيئة لا ينظر إليه كإجراء بيئي فقط وإنما كضرورة لتحقيق العدالة المناخية وضمان مستقبل آمن للأجيال القادمة ، ونقل التكنولوجيا ، وبناء القدرات من خلال التعاون الدولي وتكامل السياسات البيئية لتحقيق التوافق بين حماية البيئة والتنمية المستدامة بما يضمن الإستخدام الرشيد للموارد الطبيعية ، كما يتطرق الموضوع لبيان موقف العراق من قواعد الحماية تلك إذ تكلل هذا الموقف بالإنضمام الرسمي لها من جانب ، والبحث في مسألة الإستراتيجية الوطنية لتحسين البيئة في العراق للفترة من 2024- 2030 من جانب آخر0
