مدى مشروعية الاستعانة بالمُخبر السري

يُشكل الإخبار إحدى الوسائل المهمة التي يتم الاستناد إليها في اكتشاف الجرائم، وهو إلى جانب كونه واجب قانوني ضمن شروط معينة، فإنه يشكل أيضًا واجب أخلاقي وأدبي نظرًا لدوره في حماية الفرد والمجتمع من الجريمة. كما ترك المشرع العراقي للمُخبر السري كامل الحرية في اختيار طريقة الاخبار، حيث لم يلزمهُ باتباع طريقة معينة. كما ترك القانون للمُخبر حق طلب عدم الكشف عن هويته، وعدم اعتباره شاهدًا، في الجرائم الماسة بأمن الدولة الداخلي أو الخارجي وجرائم التخريب الاقتصادي والجرائم الأخرى المعاقب عليها بالإعدام أو السجن المؤبد أو المؤقت. وفي هذه الحالة للقاضي أن يثبت ذلك مع خلاصة الإخبار في سجل خاص يعد لهذه الغاية، ويقوم القاضي بالتحقيقات اللازمة دون الكشف عن المخبر او بيان هويته. ونتيجة لذلك اُثير جدلًا واسعًا حول قانونية عمل المخبر السري، وتحديدًا بما يتعلق بعدم الكشف عن هويته أو اعتباره شاهدًا، حيث اعتبر البعض أن ذلك يشكل مخالفة لحق الدفاع، المحمي بموجب الدستور والقانون.
