يتناول هذا البحث الصلح الجنائي باعتباره من الوسائل البديلة للعقوبة في اطار العدالة الناجزة التي يعتبر هذا النظام من ابرز ادواتها ومدى مساهمته في تعزيز دور ضحية الجريمة من حيث تمكينه من المشاركة الفعالة في الاجراءات الجزائية وضمان حقه في التعويض ويستعرض هذا البحث اثر الصلح على مركز الضحية وحقوقها في مراحل قبل المحاكمة واثناءها وبعدها مع الاخذ بالاعتبار موقف المشرعين العراقي والمصري وتناول هذا البحث بالدراسة الضمانات القانونية التي تحيط بنظام الصلح الجنائي لضمان عدم تحوله الى اداة لإفلات الجاني من العقاب دون جبر ضرر الضحية بالتركيز على العدالة التصالحية مع عدم الاضرار بحقوق الضحية
