التقاضي عن بعد هو استخدام التكنولوجيا الرقمية لتسهيل الإجراءات القضائية بدون الحاجة للتواجد الشخصي في المحكمة. يعتمد هذا النظام على استخدام منصات إلكترونية لتقديم الدعاوى، تبادل المستندات، عقد جلسات المحاكمة، وإصدار الأحكام عبر الإنترنت. يتيح التقاضي عن بعد للقضاة، المحاميين، والمتقاضين إجراء العمليات القضائية بفعالية وسرعة، مما يسهم في تقليل التكاليف والوقت.
وتتمثل مزايا التقاضي عن بعد في تحسين الوصول إلى العدالة، خاصة في المناطق النائية أو للأفراد الذين يواجهون صعوبة في التنقل. كما يعزز من الكفاءة ويقلل من الزحام في المحاكم. ومع ذلك، يواجه هذا النظام تحديات مثل الفجوة الرقمية، مشاكل الأمان السيبراني، وصعوبة الوصول إلى التكنولوجيا لبعض الفئات. ومن الوسائل التقنية المستخدمة في التقاضي عن بعد: منصات تقديم الدعاوى الإلكترونية، تطبيقات مؤتمرات الفيديو، التوقيع الإلكتروني، وأدوات تبادل الأدلة الرقمية. لتطوير هذا النظام، يجب تعزيز البنية التحتية التقنية، تحديث التشريعات القانونية، وتدريب المحاميين والقضاة على التعامل مع التقنيات الحديثة.
