إن حرية التعبير هي حجر الزاوية لأي مجتمع حر وديمقراطي وتعتبر من حقوق الإنسان الأساسية، إلا أن بعض الأشخاص وتحت ستار الحق في حرية الرأي والتعبير يمجدون الأعمال الإرهابية، وترتبط جريمة تمجيد الإرهاب بالفئة الغامضة لخطاب الكراهية، حيث أنها تشكل اعتداء على التماسك الاجتماعي من خلال المساهمة في تقدير الإرهاب أو تشجيعه وقد تشجع ايضاً على التحركات المستقبلية لارتكاب جرائم إرهابية. وقد جرمت العديد من الدول الغربية تمجيد الإرهاب في قوانينها، ولعل أبرز هذه الدول وأول من جرّم هذا النوع من الإرهاب هي فرنسا التي تعتبر من الدول التي فرضت قيوداً على حرية التعبير واعتبرت أن التعليقات التي تهدف إلى تقديم أو التعليق بشكل إيجابي على الأعمال الإرهابية بشكل عام أو أعمال إرهابية محددة ارتكبت بالفعل تعد جريمة يعاقب عليها القانون بموجب قانون العقوبات الفرنسي النافذ، ويطلق على هذا النوع من التعبير عن الرأي جريمة تمجيد الإرهاب (التبرير للإرهاب أو الترويج للإرهاب أو جريمة التحريض غير المباشر على الإرهاب ) .
