المواجهة التشريعية لجرائم المعلوماتية في العراق : دراسة مقارنة

شهد العالم تحولاً جذرياً نحو الرقمنة، مما أدى إلى ظهور نمط مستحدث من الجرائم يتجاوز الحدود التقليدية للمكان والزمان، وهي "الجريمة المعلوماتية". هذا النوع من الإجرام لم يعد يستهدف الأفراد فحسب، بل بات يهدد الأمن القومي واقتصاد الدول، مما وضع النظام القانوني أمام تحدٍ حقيقي في مواءمة القواعد الإجرائية التقليدية مع طبيعة التطور الرقمي وما افرزه ذلك التطور من أنماط جديدة في علم الاجرام, الامر الذي اثار تساؤلات عديدة حول طبيعة تلك الجريمة , وما هي الوسائل اللازمة لأثبات تلك الجريمة في التشريع العراقي وبعض التشريعات العربية.
