هدف هذا البحث إلى تحليل التحولات الجذرية في مفهوم وممارسة سلطة الضبط الإداري في العراق بعد عام 2003. فبعد عقود من الحكم المركزي الشمولي الذي منح هذه السلطة صلاحيات واسعة وغير مقيدة تحت شعار الحفاظ على النظام العام، أفرزت المرحلة الجديدة تحديات تتطلب الموازنة الدقيقة بين متطلبات استقرار الدولة والأمن المجتمعي، وصون الحقوق والحريات الأساسية للأفراد المنصوص عليها في الدستور الجديد والمعايير الدولية. سيتتبع البحث مسار تطور هذه السلطة ضمن السياق العراقي المعقد الذي يتميز بالتحديات الأمنية والسياسية والاقتصادية. كما سيكشف عن الجدلية الكامنة في العلاقة بين الحفاظ على النظام العام وحماية الحقوق والحريات، مستعرضًا الإطار القانوني الناظم لهذه السلطة، والتحديات التي تواجه ممارستها في الواقع، والآثار المترتبة على ذلك على دولة القانون وحقوق المواطنين. يعتمد البحث على منهج تحليلي نقدي، مستندًا إلى مصادر قانونية ودستورية، وقرارات قضائية، ودراسات متخصصة، بالإضافة إلى تقارير المنظمات الدولية والمحلية المعنية بحقوق الإنسان. ويسعى البحث إلى تقديم رؤية شاملة للوضع الراهن لسلطة الضبط الإداري في العراق، مع اقتراح توصيات تساهم في تعزيز دولة القانون وحماية الحقوق والحريات في ظل التحديات القائمة.
