يتناول هذا البحث الآثار القانونية المترتبة على إفشاء بيانات تركيبة الدواء بوصفها من قبيل الأسرار الصناعية والمعلومات غير المفصح عنها التي تحظى بحماية قانونية خاصة. ويبحث الموضوع في الحماية القانونية لتركيبة الدواء في ضوء القواعد العامة في المسؤولية المدنية عند وقوع الإفشاء غير المشروع فضلاً عن أحكام قانون براءات الاختراع العراقي والتشريعات ذات الصلة. كما يسلط البحث الضوء على الآثار المدنية والجزائية والإدارية المترتبة على هذا الإفشاء، ومنها التعويض عن الضرر، ووقف الاعتداء، وإمكانية مساءلة الفاعل بحسب الأحوال تأديبياً أو جزائياً، مع بيان مدى قيام المسؤولية سواء كان الإفشاء صادراً عن موظف أو شريك أو اي شخص آخر يُفشي البيانات.
