آليات تطبيق اللامركزية السياسية وضماناتها الدستورية

في العراق بعد عام 2005 تعد اللامركزية السياسية احدى ابرز ملامح النظام الدستوري العراقي،اذ تبناها دستور جمهورية العراق كاساس لضمان التعددية،وتوزيع السلطات داخل الدولة من جهة،ومن جهة اخرى تحقيق التوازن بين مكونات المجتمع العراقي،ومن خلال اقرار النظام الاتحادي الذي يوزع الاختصاصات بين الاقليم والحكومة الاتحادية تجسدت هذه اللامركزية،ان الاطار النظري للبحث يبين ان اللامركزية السياسية في العراق تقوم على اسس دستورية وقانونية واضحة ومحددة،ولكن المشكلة تكمن في آليات التطبيق التي واجهت صعوبات سياسية وعملية تمثلت في تضارب الصلاحيات وغياب التنسيق بين الاقليم والمركز فضلا عن تأثر التجربة بالعوامل الحزبية والطائفية. كما اظهر البحث ان ضمانات اللامركزية السياسية في العراق تتوزع بين ضمانات سياسية تتمثل في مشاركة المكونات المختلفة بالعملية السياسية،وضمانات قضائية تتمثل بدور المحكمة الاتحادية العليا في تفسير الدستور وفض النزاعات بين سلطات الاقليم وبين السلطات الاتحادية وضمانات شكلية كالنصوص الدستورية والقوانين ،ان نجاح تطبيق اللامركزية السياسية في العراق متوقف على تكافل النصوص مع التطبيق وبوجود بيئة سياسية مستقرة فضلا عن تعزيز الرقابة القضائية وتفعيل مبادئ التعاون والتنسيق بين المستويات المختلفة للسلطة.
