الاستخدام المعاصر للذكاء الاصطناعي في مجال التحقيق الجنائي

الملخص

     في ضوء التطورات العالمية في تقنيات الذكاء الاصطناعي، اصبح لها دور متزايد في المجالات القانونية، وبشكل خاص في التحقيقات الجنائية، فقد باتت الجهات المختصة تعتمد على تحليل البيانات والتعرف الذكي على الانماط والادلة، وهو ما غير طبيعة العمل التحقيقي التقليدي، الا ان هذا التحول الرقمي، وعلى الرغم من امكاناته الكبيرة، يثير تساؤلات قانونية ومجتمعية حول مدى مشروعيته وحدوده وضماناته، فتناولنا الادوات الذكية المستخدمة في جمع وتحليل الادلة سواء المادية منها كالبصمات والحمض النووي والتعرف على الوجه، او الرقمية كتحليل البيانات الرقمية الضخمة.

   ويركز البحث على الاطار القانوني الذي ينظم استخدام هذه التقنيات، لاسيما في ظل عدم وجود نصوص صريحة في القانون العراقي تعالج هذه المسائل، كما يبين البحث اثر هذه الادوات على اجراءات التحقيق الجنائي وحقوق المتهم.
