يعد علم المواريث من أجل العلوم الشرعية التي اوصى البني محمد (صلى الله عليه وسلم) بتعلمها وتعليمها لما فيها من حفظ مقصد عظيم من مقاصد الشريعة الإسلامية وهو حفظ المال وهذا المال تحفظ فيه النفس والسؤال عن الناس وغيره من المنافع الآخرى وقد حدد الشارع الحكيم نصوصاً قطعية بالنسبة لأصل الورثة من الوالدين والأقربين وجاءت السنة النبوية مكملة لها ولعل أبرز ما جاءت به السنة النبوية ميراث العصبة بالنفس والعصبة مع الغير فقد خص لكل منهما حديث قاله النبي محمد (صلى الله عليه وسلم) وقد شاع فهم مجانب للصواب في كيفية توريثهم في حال انفرادهم ، واختلف الفقهاء المسلمون في تقديم بعضهم على الآخر في حال اجتماعهم فسلط هذا البحث الضوء على هاتين المسألتين وتصويب الفهم الشائع غير الصحيح في توريثهم واختيار الرأي الراجح في تقديم احدهما على الآخر في حال اجتماعهم مع بيان موقف المشرع العراقي من كل ما تقدم.
