الضمانات القانونية للعمالة الوافدة إلى العراق: إشكاليات التطبيق والحلول المقترحة

يتناول البحث التنظيم القانوني لعمل العمالة الوافدة في العراق في ظل قانون العمل رقم (37) لسنة 2015، الذي يهدف إلى الموازنة بين الحاجة إلى العمالة الأجنبية، ولا سيما الماهرة، وحماية العمالة الوطنية، في ضوء تزايد أعداد الوافدين بعد عام 2003 وما ترتب على ذلك من آثار اجتماعية واقتصادية وأمنية. ويشترط القانون عدم تشغيل العامل الأجنبي إلا بإجازة عمل رسمية، مع تمتعه بحقوق أساسية مماثلة للعامل الوطني من حيث الأجر والراحة والسلامة المهنية، والتزام صاحب العمل بتوفير الإقامة القانونية والتأمين الصحي والاجتماعي وتذكرة السفر. غير أن التطبيق العملي كشف عن دخول كثير من العمال بتأشيرات سياحية أو تجارية وعملهم دون إجازة، بما يحرمهم من الحماية القانونية ويعرّضهم للاستغلال، فضلاً عن منافستهم للعمالة الوطنية، وارتفاع البطالة، وتحويل نحو 600 مليون دولار سنوياً إلى الخارج. كما يظهر ضعف الرقابة والتفتيش في متابعة الالتزام بنسبة (20% أجنبي مقابل 80% عراقي)، مع تسجيل انتهاكات كحجز الوثائق والأجور والعمل القسري، مما يدل على أن التنظيم القائم متقدم نظرياً لكنه يحتاج إلى تنفيذ أكثر فاعلية.
