حدود وضوابط استخدام الذكاء الاصطناعي في القضاء الدستوري :دراسة تحليلية في ضوء مبدأ استقلال القضاء

تتمحور فكرة البحث حول اختبار مدى مشروعية وقدرة الذكاء الاصطناعي على استيعاب خصوصية المنازعة الدستورية، بوصفها قضاءً سيادياً يهدف لحماية كيان الدولة وقيم الدستور، بما يتجاوز قدرة المنطق الخوارزمي الصوري على إدراك الموازنات الفلسفية والاجتماعية التي يرتكز عليها الوجدان البشري، وتكشف الدراسة عن عجز التقنيات الذكية عن الحلول محل القاضي الدستوري في عملية التكييف والتسبيب، مما يفرض حصر دورها في النطاق "المساعد والكاشف" للسوابق والنصوص فقط تحت رقابة بشرية كاملة. مما يستوجب حتمية صياغة إطار قانوني يمنع انفراد الخوارزميات بصناعة الحكم أو المساس باستقلال القضاء، ويُلزم بالإفصاح عن استخدام أي أداة ذكية ضماناً لحق الدفاع؛ تحصيناً للقرار القضائي من البطلان الناجم عن غياب التفسير المنطقي والسيادي للمبادئ الدستورية السامية.
