عقد الوكالة في ظل جائحة كورونا (دراسة مقارنة)

من المتعارف عليه ان جائحة كورونا وباءه عالمي حسب توجيه منظمة الصحة العالمية، حيث انها عطلت جميع مرافق الحياة وادخلت العالم بحالة من القلق والاستنفار، وبالتالي فأن عقد الوكالة في القانون المدني والذي يعتبر من قبيل العقود المسماة، وهي ذات أهمية كبيرة في مختلف مجالات الحياة وتُعتبر “عقداً يقيم به شخص غيره مقام نفسه في تصرف جائز” حسب ما ورد في تعريف القانون المدني العراقي بنص المادة 927 يمكن ايضاً ان يتأثر بالجائحة المذكورة. وقد قسم المشرع العراقي الوكالة الى أنواع منها الوكالة العامة، والوكالة الخاصة، والوكالة الجزائية ووكالة المركبات، وأورد المشرع عدة خصائص ميز بها عقد الوكالة. ومن ابرز ما أورده المشرع من التزامات على الوكيل هو المحافظة على أموال موكله، بالإضافة الى التزام بعدم تجاوز حدود موكله، وبذل مقدار العناية اللازمة في تنفيذ الوكالة. ويمكن انتهاء عقد الوكالة بحكم القانون وذلك في حالة وفاة الوكيل او الموكل او خروج احدهما عن الاهلية، او تنتهي الوكالة بأسباب ارادية تتمثل بقيام الموكل بعزل وكيله او حق الوكيل باعتزال الوكالة.
