يتناول هذا البحث موضوع الحماية الجنائية لحرية الفكر والرأي والتعبير، بوصفها احدى اهم الحريات التي كفلتها الدساتير والمواثيق الدولية، والتي تشكل ركيزة أساسية في بناء الدولة القانونية. رغم جوهرية هذه الحرية إلا انها، محاطة بقيود تمليها ضرورة احترام النظام العام وحقوق الاخرين. ومن ثم، فأن تدخل المشرع الجنائي لتجريم بعض الأفعال التي تمثل انحرافا في ممارسة هذه الحرية، كالسب والقذف، او نشر الاخبار المضللة التي تهدد السلم الاجتماعي. ويهدف هذا البحث الى بيان الكيفية التي يسعى من خلالها القانون الجنائي الى تحقيق التوازن بين حماية حرية التعبير باعتبارها حقا دستوريا، وبين ضرورة صون كرامة الافراد والمصلحة العامة، خصوصا في ظل التحديات التي يفرضها الفضاء الرقمي وتعدد وسائط النشر الحديثة.
