يتناول هذا البحث الإطار التشريعي المنظم لتخصيص الوظائف المحجوزة من خلال دراسة مقارنة بين العراق ومصر، بوصفه أحد الاستثناءات الواردة على مبدأي المساواة وتكافؤ الفرص في الالتحاق بالوظيفة العامة. وينطلق البحث من التأكيد على أن الأصل في التعيين هو الخضوع للمنافسة العامة القائمة على الكفاءة والاستحقاق، غير أنّ المشرّع قد يتدخل، لأسباب إنسانية أو اجتماعية أو سياسية، ليُقرّ نظاماً خاصاً يخصّص بموجبه بعض الوظائف لفئات معينة، مثل ذوي الإعاقة وأسر الشهداء والمفصولين لأسباب سياسية، تحقيقاً للعدالة الاجتماعية وردّاً للاعتبار وتعويضاً عن أضرار سابقة، ويخلص البحث إلى أن نظام الوظائف المحجوزة يُمثل أداة استثنائية مشروعة متى ما استند إلى مبررات موضوعية واضحة، ونُظم ضمن إطار تشريعي متكامل يوازن بين مقتضيات العدالة الاجتماعية ومتطلبات الكفاءة والمصلحة العامة. كما يؤكد البحث الحاجة إلى توحيد وتنقيح النصوص المتفرقة المنظمة لهذا النظام في العراق ومصر، بما يضمن وضوحه، ويحدّ من إساءة استخدامه، ويُعزز انسجامه مع المبادئ الدستورية الحاكمة للوظيفة العامة.
