الملخص

تناولنا في هذا البحث المخالفات التأديبية لاعضاء المجلس النيابي ضمن اطار الدراسة المقارنة لما يمثله سلوك الاعضاء من ركيزة اساسية لحسن سير العمل النيابي في المؤسسات النيابية وصون هيبتها، وتكمن الاشكالية في مدى قدرة القواعد الدستورية وفاعلية الانظمة واللوائح الداخلية للمجالس النيابية في تنظيم المخالفة التأديبية للاعضاء واثارة المسؤولية التأديبية اذ ما خالف العضو الواجبات النيابية والخروج على مقتضيت الصفة النيابية، عن طريق الحنث باليمين الدستورية أو عدم التفرغ لاداء العمل النيابي أو استغلال صفته النيابية للتعامل مع الدولة في الامور المالية وعند اخلاله بنظام الجلسات عن طريق غيابه عن الجلسة النيابية أو الاخلال بقواعد النظام، واعتمد في هذا البحث على المنهج التحليلي مدعوماً بالمنهج المقارن من خلال دراسة النصوص القانونية ذات الصلة، وخلص البحث إلى أن انتهاج الاعضاء سلوكيات من شأنها تعطل العمل النيابي وتضعف من ثقة الشعب بالمؤسسة النيابية لذا دعت الحاجة الملحة لتطوير القواعد القانونية في مواجهة هذه السلوكيات اضافةً الى تفعيل دور القوانين والانظمة بما ينسجم مع تطورات الحياة.
