من المبادئ المعترف بها دوليًا مبدأ حق الشعوب في تقرير مصيرها من خلال تضمينه في مواثيق المنظمات الدولية العالمية والإقليمية، وكذلك في الاتفاقيات الدولية لحقوق الإنسان. بالإضافة إلى ذلك، لعبت الأمم المتحدة دورًا هامًا في تفعيل هذا المبدأ من خلال قرارات الجمعية العامة ومجلس الأمن. وعليه فإن استخدام هذا الحق كأداة دولية لتحقيق استقلال الدول التي كانت تحت الاستعمار، وإضفاء الشرعية القانونية على حق الشعوب في تقرير مصيرها، يستند إلى هذه المواثيق الدولية. تهدف هذه الورقة البحثية إلى تسليط الضوء على ماهية حق تقرير المصير في القانون الدولي، ودراسة حالة معاصرة القضية الفلسطينية لتطبيق هذا الحق في ظل الممارسات الدولية.
