آلية تعديل دستور جمهورية العراق لعام 2005 – دراسة مقارنة

المرتكز الاساسي لنظام الحكم في أي دولة هو الدستور، فهو الذي يعكس صورة وأوضاع المجتمع وهذه الاوضاع في تغير دائم، وهذا هو السبب الاساسي لتعديل الدستور، يـأتي التعديل الدستوري لتطوير الشرعية القائمة لمواجهة بعض المسائل التي لم يعالجها الدستور، أو لمواجهة المتغيرات والتطورات التي تحدث في المجتمع في جميع الجوانب السياسية والاقتصادية والاجتماعية، وهذه التطورات والمتغيرات تتطلب معالجة دستورية جديدة تحقق الاهداف العليا للدولة، وعلى هذا النحو يهدف الاصلاح الدستوري من خلال التعديل إلى حمايته وضمان استمراره، إلا أن طريق تعديل الدستور يختلف باختلاف كون الدستور مرنا أو جامدا، وايضا يختلف من دستور جامد لأخر تبعا لصعوبة وتشديد الإجراءات وتعقيدها المتبعة في التعديل، وايضا تحديد السلطة المختصة بالتعديل والمراحل التي تمر بها عملية تعديل الدستور.
