تُظهر تجربة العراق مع جرائم الإبادة الجماعية التي ارتكبتها عصابات داعش ضد الأقليات الدينية، خصوصاً المكون الإيزيدي، كيف أن العدالة الدولية لم تكن بمنأى عن التسييس والتوظيف السياسي. فرغم أن الجرائم استوفت معايير الإبادة وفق اتفاقية 1948، ظلّ الاعتراف الدولي بها متأرجحاً بين البعد القانوني والاعتبارات السياسية. وقد انعكس ذلك في مواقف مجلس الأمن وآليات المحكمة الجنائية الدولية، حيث تأخرت إجراءات المساءلة وخضعت لتوازنات القوى الكبرى.
قرار مجلس الأمن 2379 لسنة 2017، المتعلق بإنشاء فريق التحقيق الأممي (UNITAD)، شكّل خطوة مهمة في توثيق الجرائم، لكنه بقي محدود التأثير بفعل القيود السياسية التي حالت دون محاكمات دولية واسعة. كما برز الدور العراقي في محاولة تدويل القضية وحشد الدعم الدولي، غير أن التحديات السياسية حدّت من فاعلية هذه الجهود.
وتؤكد هذه الحالة أن التسييس في تطبيق العدالة الدولية يضعف من مصداقيتها ويجعلها انتقائية، الأمر الذي يثير تساؤلات حول مستقبل النظام القانوني الدولي، وإمكانية إصلاحه بما يضمن استقلاله عن الضغوط السياسية.
