The decline of the legislative exclusivity of the Council of Representatives in financial legislation

The broad powers enjoyed by the legislative authority in proposing, discussing, and voting on laws—reflecting the general will of the people and their true legal representation through a lawfully elected legislative body—have evolved and undergone change. Many countries and constitutional systems have witnessed a retreat from the principle of exclusive legislative authority and a decline in its prevailing concept, particularly in financial legislation. This shift is due to the executive authority’s involvement in the legislative process and its participation in legislative roles for various reasons. Over time, this involvement has grown from mere assistance in legislation to extensive dominance over it, expanding the executive’s influence significantly in the lawmaking process. The executive branch has come to play a major role in shaping financial laws, either in accordance with constitutional provisions that grant it such powers, through broad interpretation of constitutional texts, or even by exceeding them. This has led to the erosion of parliament’s role as an independent legislative body, especially in certain stages of the financial lawmaking process.
